The protection of your personal data is particularly important to us. Your personal data will therefore only be processed in accordance with the principles of the General Data Protection Regulation (GDPR) and the Austrian Data Protection Act 2018 (DSG 2018) to the extent that this is permitted by the existing legal provisions and is necessary to fulfil the respective purpose (fulfillment of our contractual services, fulfillment of legal obligations, sending of information material and advertising or sending a newsletter).

When you book a course place, workshop or co-making subscription, we collect the following data to manage your booking, process the payment and send you information material about courses, workshops, co-making offers and news:

For what purpose:

We process your first name, last name and your bank details (IBAN & BIC) on the legal basis of contract performance and require these for booking the course or your subscription as well as for processing the payment.

We process your email address on the basis of our legitimate interest for the following purposes:

  • contact option

  • confirmation email

  • Information regarding debit or payment

  • Relevant logistical information

  • Issuing and sending email invoices for courses, workshops, co-making and events

We process your telephone number on the legal basis of our legitimate interest in telephone contact options for the organization of course places and the allocation of course places.

We process your name and email address to send you our email newsletter and other information about our company's services and products:

Purpose:

Based on the legal basis of our legitimate interest, if you are one of our customers and have not objected to this use of your data when it was collected, we will send you emails about offers, courses, products, collaborations and relevant information about rami for marketing purposes.

You can also sign up for our newsletter on our website or in our studio. This is done using the double opt-in process. After registering, you will receive an email asking you to confirm your registration. Without providing this information, we will not be able to send you our newsletter. You can unsubscribe from the newsletter by clicking on the unsubscribe link at the end of each newsletter.

We have a legitimate interest in taking photographs for marketing purposes at events and in the context of courses, workshops and generally in the co-making studio and publishing them on our website and on social media channels. Publication does not give rise to any claims.

If you do not agree with this, you can object to processing and publication at any time.

> Website

Course instructors, Artistic Advisory Board members and selected customers with 15 hours/week subscriptions are represented on the rami website (www.rami-ceramics.com). This only happens if the persons concerned have expressly consented to the publication of their name on the website for the purposes of online representation.

  • Representation of the rami course and workshop leaders

  • Representation of the rami Artistic Advisory Board

  • Representation of advanced rami co-making members

> Social Media

We use social media channels for communication purposes only if you have added rami to your contact list on these social media channels and have not objected to communication via these channels, or have set this in your privacy settings on the respective platform.

We also share photos of courses, exhibitions and events on rami's social media channels. These recordings may also contain personal data about you (e.g. photos in which you are recognizable). We use this data for documentation and marketing purposes based on our overriding legitimate interests. You can object to use for these purposes at any time.

> Shop – on-site and online (future)

We also operate a shop. If you order from us, you will be issued an invoice and, in the case of an online order, the corresponding products will be sent to you. Personal data is only collected in the case of orders via our rami online shop and processed for the purposes of processing the sale. If you buy products locally, we do not process any personal data for this purpose.

We process the following data when you order from our online shop:

We process this data on the legal basis of contract fulfillment for the purposes of confirming the order, issuing and sending email invoices, processing the order, and for accounting purposes.

We issue invoices for our material purchases, course organization and cooperation with our partners.

We use this data on the basis of the legal basis of contract performance and due to legal obligations (accounting, tax office) for the purpose of issuing and sending electronic invoices by email, as well as for issuing and delivering postal invoices.

  1. Who do we share your data with

Your personal data will not be passed on to third parties, except:

  • We are legally obliged to do so, for example under the Telecommunications Act (TKG), the German Criminal Code (StGB) or the German Code of Criminal Procedure (StPO).

  • to authorized medical personnel in medical emergencies.

  • based on your express written consent

  • If you have not fulfilled your contractual obligations despite a reminder, your data, namely name, address, date of birth, [...] will be passed on to a debt collection agency due to a legitimate interest for the purpose of collecting outstanding debts.

  1. Who do we commission to process your data

If we engage a processor, we remain responsible for protecting your personal data.

We therefore only commission external processors to carry out activities that are necessary to provide our services, such as IT service providers for the operation and maintenance of our website, namely easyname.at; mailing service providers for sending newsletters, namely Mail Chimp, etc. These have committed themselves to complying with the applicable data protection regulations. A corresponding order processing contract has been concluded in accordance with Art. 28 GDPR.

  1. How long do we process your data

We process your personal data - if necessary - for the duration of the entire co-making membership, course or workshop. After a course or membership has expired, we store your personal data for a maximum of 2 years in order to simplify further memberships or course bookings. In addition, data is stored in accordance with the statutory retention periods applicable to us and any limitation periods and claims for damages. We then delete your personal data.

We store data that you have made available to us for marketing and information purposes, such as for sending a newsletter, until you object to the sending and revoke your consent to the sending.

Furthermore, we store your personal data in accordance with the statutory retention periods, such as:

Accounting, tax and customs law:

  • Tax retention obligation according to Section 132 Paragraph 1 BAO: 7 years beyond that as long as they are relevant to the tax authorities in a pending procedure)

  • Corporate retention period according to §§ 190, 212 UGB: 7 years

  • VAT retention obligations according to Section 18 Paragraph 10 UStG (special provision for real estate): 22 years

  • VAT retention period according to Section 18 Paragraph 2, 3rd subparagraph: 7 years

  • Records according to Section 23 Paragraph 2 of the Customs Law Implementation Act: 5 years

Contractual matters:

  • Warranty according to § 933 ABGB: 2 years (movable items), 3 years (immovable items)

  • Purchase price claim for movable property according to § 1062 in conjunction with § 1486 ABGB: 3 years

  • Claims arising from a work contract pursuant to Section 1486 ABGB (if the service was provided within the framework of a commercial or other business operation): 3 years

  • General compensation according to § 1489 ABGB (compensation claims): 3 years (if the damage and the person responsible are known) / otherwise 30 years (also applies to work accidents!)

  • Liability claims according to § 13 PHG: 10 years

  1. How secure is your data

We use technical and organizational security measures to protect your personal data against accidental or intentional alteration, loss or destruction and against unauthorized access. Our security measures are of course continuously improved in line with technological advances.

With regard to the processing of your personal data, you can assert the following rights:

  1. right to information

You can request confirmation from us as to whether and to what extent we process your data. This will also tell you the purposes for which we process your data, the categories of your personal data processed, the recipients or categories of recipients of your personal data, and the duration of the data processing.

  1. right to rectification

You can request at any time that incorrect or incomplete data concerning you be corrected and/or completed immediately.

  1. right to erasure

You can request that we delete your personal data if we process it unlawfully, if the processing disproportionately interferes with your legitimate interests in protection, if the personal data is no longer necessary for the purposes for which it was collected, or if you have withdrawn your consent to processing. Please note that there may be reasons that prevent immediate deletion, such as in the case of statutory retention periods.

  • the processing of the data is unlawful, but you refuse to delete it and instead request a restriction on the use of the data;

  • we no longer need the data for the intended purpose, but you still need this data to assert, exercise or defend legal claims, or

  • you have objected to the processing of your data.

You can request that we provide you with the data you have provided to us in a structured, common and machine-readable format, provided that

  • we process this data on the basis of a consent given by you and revocable, or to fulfill a contract between us, and

  • this processing is carried out by automated means.

  1. right of objection

For reasons related to your particular situation, you can object at any time to the processing of personal data concerning you that is necessary to protect our legitimate interests or those of a third party, in accordance with Art. 21 GDPR. We will no longer process your data after your objection, unless there are compelling legitimate reasons for the processing that outweigh your interests, rights and freedoms or if the processing serves to assert, exercise or defend legal claims.

You can object to receiving the electronic newsletter at any time without giving reasons.

If you have given us your consent to process your data for certain purposes, you can revoke this consent at any time free of charge and without giving reasons.

If you believe that we are violating national or European data protection law when processing your data, you can contact us at any time.
